Council decision on social care

Harrow Council has been the subject of a judicial review over its decision to provide adult social care for those with critical needs only.

A High Court Judge ruled that Harrow Council's decision to tighten the criteria for those eligible for adult social care was unlawful because they had not given due regard to their responsibilities in disability law.

However, Judge Mackie QC did not quash Harrow's overall decision to change the criteria for social care.

Councillor David Ashton, Deputy Leader and Portfolio Holder for Finance at Harrow Council said:

"We are pleased that the court has not quashed our decision. We accept the judges conclusions.

"Nothing will happen until we have given proper consideration to our legal duties to disabled people.

"This was not a decision that the council wanted to make but one we were forced to take in response to the need of balancing the budget in response to consistently low government grants."
