Determining the height of a chimney

If you want to change the height of a chimney, you need to get approval from the Council.

Smoke emissions and the height of chimneys are regulated under The Clean Air Act 1993.  Under section 14 of the Act, the height of the chimney must be approved by the Council and any conditions attached to approval adhered to.

It is an offence to cause or knowingly permit a furnace to be used to: 
  • burn pulverised fuel
  • burn at a rate of 45.4 kg or more an hour any other solid matter or
  • burn at a rate equivalent to 366.4 kW or more any liquid or gaseous matter

How do I apply?

You will need to complete an application form (see the download below). For assistance with completing the application form, please contact Environmental Protection.

We will aim to consider your application within 28 days of receipt, unless it is agreed otherwise with yourself.

There is currently no fee for this application.

What factors will influence the approval of an application?

Approval shall not be granted if it is judged that the height of the chimney will be insufficient to prevent the smoke, grit, dust, gases or fumes given off by the proposed chimney being prejudicial to health or a nuisance regarding:

(a) The purpose of the chimney
(b) The position and descriptions of buildings near it
(c) The levels of the neighbouring ground
(d) Any other matters requiring consideration in the circumstances.
